New York Paid Family Leave (NYPFL)

New York Paid Family Leave provides eligible employees 12 weeks of job protected leave to:

  • Bond with a newly born, adopted or fostered child.
    • This leave can be taken within the first year of the life, within the first year of the adoption, or within the first year of the child’s placement.
  • Care for a family member with a serious health condition.
    • This leave can be taken to care for an eligible family member with a serious health condition. Eligible family members are: spouse, domestic partner, child/stepchild, parent/stepparent, parent-in-law, grandparent, grandchild, and siblings
  • Assist loved ones when a spouse, domestic partner, child or parent is deployed abroad on active military service.
    • This leave can be taken when you time to assist with family situations arising when an eligible family member is on active service in a foreign country or has been notified of an impending call or order of active service to a foreign country. Eligible family member is: spouse, domestic partner, child, or parent.

Eligibility

Any full-time employee or any employee who works a regular schedule of 20 or more hours per week are eligible after 26 consecutive weeks of employment.  

Any part-time employee who works a regular schedule of less than 20 hours per week are eligible after 175 days, which do not need to be consecutive. Employees with irregular schedules should look at their average schedule to determine if they work, on average, fewer than 20 hours per week.

Pay

The wage benefit is 67% of your average weekly wage, capped at $1,177.32. Guardian will pay employees directly for all approved NY PFL days.

Cost

This leave if funded through employee payroll deductions. In 2025, the employee contribution is 0.388% of an employee’s gross wages each pay period. The maximum annual contribution is $354.53.

Waiving Coverage

Paid Family Leave is not optional for eligible employees. Coverage can only be waived if:

  • The employee is regularly scheduled for less than 20 hours per week and will not work 175 days in a year, or
  • The employee is regularly scheduled for 20 or more hours per week, but won’t be in employment 26 consecutive weeks.
